ATPL(H) credits CPL H + IR
Hi everybody, I'm trying to find out if somebody had credits from the CAA for taking the ATPL H holding an old JAR-FCL CPL amendment 3 license and an EASA IR rating issued in 2013.
I'll attached the answer I got from the licensing department but I believe I'm on the right side.

However, it is our opinion that, if you have a CPL(H) issued under JAR FCL Amendment 3, that is the equivalent of the ATPL(H)(VFR) in terms of theoretical knowledge - paragraph 2.050(b)(10) refers. This credit was carried over into Part FCL. In addition, Article 4(1) of Commission Regulation (EU) 1178/2011 refers to JAR compliant licences being deemed to be Part FCL licences. The legal definition of "JAR Compliant" licence is in Article 2, which refers to licences, ratings, certificates, authorisations and other qualifications issued or recognised by a State, reflecting "JAR and procedures". We interpret this to include ATPL(H) TK credit.
Although JAR-FCL 2 at amendment 6 did state at ‘JAR–FCL 2.050 (b) (10) The holder of a CPL(H) gained under previous amendments of JAR-FCL 2 up to and including Amendment 3 is credited with the theoretical knowledge requirements for ATPL(H).’ The UK CAA did not implement this part of JAR-FCL 2 at amendment 6. Therefore you will be required to complete the ATPL/IR(H) exams if you wish to gain a ATPL/IR (H), credits towards the ATPL/IR(H)

been there done that got the T-shirt...
I had a CPL with ATPL (H) theory credit and in order to obtain the IFR rating I had to take five exams (again). Air law, Operational procedure, IFR Comm, Radio Nav, Flight Planning and Monitoring.
According to the authorities the Theory Credit was only good for VFR (go figure)
I didn’t ask to many questions went in took the exams got the IFR end of story
There are several different ways to interpret paragraph, amendments, appendix ….although at times way over the top of my head
