Cargoitalia sues cargolux and ENAC

Cargoitalia: Leali asks 30 million compensation to ENAC (MF)

- In addition to action against competitor Cargo Lux,
Alcide Leali, owner and founder of Cargoitalia sued
the National Agency for Civil Aviation (ENAC) requiring
compensation of 30 million.

Cargoitalia, says the MP was not 'able to withstand competition
("very unfair" Leali says in litigation) of Cargolux,
the giant of freight transport of Luxembourg in the last two years has
in fact sabotaged operators flying from Milan Malpensa, as
Cargoitalia.

The allegation of Cargoitalia is based on two pillars: the true corporate nature of Cargolux Italy and the rapidity 'with which the ENAC, in
2009, granted the license to fly in Italy. Cargolux, according to
what Leali's lawyers write in the application, is in fact a foreign firm, as it has only a minority shareholder Italian,
Rebaudo Francesco (2%). For more, point out Pierallini and Clarizia,
the competitor doesn't have a proper organization having only 12 employees and a minimum share capital (6 million) compared to 28.9 million
of Cargoitalia (which add up to 38.9 million investment account
capital). In addition, Cargolux Italy, which since 2009 has not filed
to Enac a business plan (if not in draft form), has not
an indipendent activity as the revenues (78.76 million) are fully
accrued in favor of the parent company Cargolux Sa.
