Does anybody know if a Swiss chartercompany can base aircraft at an airport inside the EU and run part of his charter opperation from here with flights inside the EU. (not from or via Switserland)

To my knowledge not (but what do i know)

There is a definition called Cabotage.......coastal trading:restriction of this within a countries territory (Chambers Dictionary)This means what it says and may answer your question. This basically means scheduled and charter work but not private use.

If you wish to operate commercially inside the EU, then I think you will need an European AOC and hence, to be owned by EU citizens.

Subsidiary company might be the answer - although you can only retain 49% ownership - but strictly, if you are using the Swiss AOC then I believe you cannot fly for hire or reward intra EU unless you apply on a case by case basis. This will be lengthy and ultimately detrimental to your operation.

I also believe that the situation with regard to Swiss companies operating within the EU will soon be changing, i.e. at some point they will be treated as an EU operator.

If a non-EU carrier departs from an EU country makes an intermediate stop in an other andthe continues to a thir non EU country . No EU AOC is needed.

If this non EU aircraft is wetleased by a JAR operator (and this aircraft is operating according to JARs) and the aviation authority approves the lease, the Swiss aircraft can fly. Also, if you manage to get non-objections from airlines operating in that country it is usually possible that you are being allowed to operate. It depends where and when and if there is a lot of competion on that route.. .. .Cheers. .fcit
