Hello,

I was wondering, in this new EASA era, is the EU-OPS 1 (COMMISSION REGULATION (EC) No 859/2008 of 20 August 2008) (http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2008:254:0001:0238:EN:PDF) still in vigor ?

If not, any idea where I can find the most recent document in vigor ?

Thanks a lot.

Regards.

The short answer to your question is 'yes', EU-OPS are still in effect.

They are currently in the process of being replaced by the new Air Operations Regulation (Commission Regulation (EU) No 965/2012 of 5 October 2012). According to paragraph (6) of the Air Operations Regulation's preamble, EU-OPS 'shall be considered repealed', however they 'remain in place temporarily until the transitional periods foreseen [...] have expired and for those areas for which no implementing measures have yet been adopted.' The flight and duty time limitations of EU-OPS, Subpart Q remain in force (Article 8 of the Air Operations Regulation), but will be implemented soon. Furthermore, EU-OPS still apply to local operations with performance class B aeroplanes (Article 6(1) of the Air Operations Regulation).

As for the above mentioned transitional periods, most Member States have decided not to apply the new rules, i.e. Annexes I to V of the Air Operations Regulation, until 28 October 2014, as provided in Article 10 of the Air Operations Regulation.

If you would like to follow the further developments, you might want to have a look at EASA's flight standards site (http://easa.europa.eu/flightstandards/).
