Dubai emir in US 'child slaves' row

Lawyers for Dubai's ruler are seeking the dismissal of a US lawsuit blaming the emir for the enslavement of thousands of children who worked as camel jockeys.

The lawsuit, filed in a federal court in Miami by parents of child jockeys, alleges Sheikh Mohammad bin Rashed al-Maktoum and others kidnapped and enslaved children.
In the nine-count complaint, the unnamed plaintiffs allege the defendants "perpetrated one of the greatest humanitarian crimes of the last 50 years".

It claims the defendants engaged in and facilitated slavery and caused the wrongful death of "numerous boys".
The Dubai ruler had earlier sought help from George Bush, the US president, in having the complaint dismissed, arguing it could affect ties between the US and the United Arab Emirates (UAE).

Jurisdiction
In court papers filed last week, the US government said it would advise the court by September 17 whether it would participate in the litigation, and asked the judge not to rule on the motion to dismiss until that date.

In their motion, the defendants' lawyers claim the court has no jurisdiction over the case, and that Sheikh Mohammad enjoys diplomatic immunity.
They also claim the complaint conflicts with the UAE's efforts to end the use of child camel jockeys.

Habib al-Mulla, who represents Sheikh Mohammad and his brother, Sheikh Hamdan bin Rashed al-Maktoum, also named as a defendant, said: "We believe we have strong grounds for a dismissal."

The two named defendants have denied the charges against them.

In their response to the motion to dismiss, the plaintiffs' lawyers insist the court does have jurisdiction as the defendants own property, including thoroughbred race horses, in the US.

They also insist the complaint does not affect efforts to end the use of child jockeys.

Compensation

The lawsuit is an embarrassment for the UAE, as it seeks to project the image of a modern, business- and tourism-friendly state.

Sheikh Mohammad is also the vice president and prime minister of the UAE, of which Dubai is part. Hamdan serves as the UAE's finance and industry minister.
On a website addressing the claims, the Dubai government touts a UAE programme supported by the UN Children's Fund to repatriate underage jockeys.

It also points to agreements signed with Pakistan, Bangladesh, Mauritania and Sudan to create a system to compensate former child camel jockeys from these countries.

The UAE has banned the use of child camel jockeys, which were favoured because of their light weight. The authorities say 1,077 children have been repatriated since 2005, while camel owners have started using remote-controlled robotic jockeys.

But the plaintiffs claim that in spite of the legislation, jockeys as young as four-years old "remained the standard of the races for much of the past 30 years".

Among the parents bringing the lawsuit is a couple who claim their son was "forcibly abducted, trafficked internationally and sold into slavery as a camel jockey and camel camp worker" at the age of two.

Sheikh Mohammad and Sheikh Hamdan are directly involved in their racing enterprises, "choosing which enslaved child will ride their camels in individual races, personally supervising the overseers who manage the camps where the abducted and enslaved boys and camels live and work, personally giving orders to the enslaved boys, and personally profiting from the boys labours," the complaint claims.

It also claims some of the boys were injected with hormones to prevent them from growing.

A young Pakistani boy was raped and killed in the bathroom of a mosque in Dubai on Friday. The man who allegedly raped and murdered the six-year-old boy has been arrested. Dubai Police said they received information that a Pakistani child was found dead in the bathroom of a mosque located in 
Al Qusais on Friday.
When the police reached the mosque, a man told them that he had come to the mosque for Zuhr prayers and that when he went to the bathroom to prepare for it, he saw traces of blood on the floor after which he saw the child behind the door. The boy’s pants had been removed.
The police, upon entering the bathroom, noticed that the child had been raped. They took the body to the General Department of Forensic Medicine and launched an investigation. Later, a Bahraini national was arrested on the suspicion of committing the crime.
He confessed to the crime during interrogation. He said he consumed alcohol late into the night on Thursday and went to the mosque to perform Eid prayers on Friday and returned home. He continued drinking alcohol and later went out to visit his friend to celebrate the festival.

You mean you've left the UAE and gone to a country where there are NO murders? NO child molestation? NO exploitation of children (I take it you don't own a pair of Nikes, now do you?)

The child Jockey thing was a scandal and it is a great thing that it has been ended. I'm sure the plaintiffs in this case will get a nice, fat settlement and they deserve it.

But are you really trying to link prospective (sorry, PERspective) employment with EK to the fact that some low-life murdered a child?

That rules out working in the UK, Australia, the US...well, just about anywhere.

If anyone wants to present factual information for or against working for EK, that's fine.

You, however, do a very nice line in BS.

Now about the kid getting killed- you post that, have it pointed out it's a BS argument because that sort of thing happens everywhere, then ignore that because you are to arrogant and blinkered to admit your post was irrelevant.

I'm reading and reading the post and trying to understand what has EK got to do with it all, the fact that all this happened in the U.A.E. and Dubai is not secret as it was in all news papers, so, did you think that you were telling us something new?
If you are going to write something about EK then please do, but don't link EK with all this as it has nothing to do. :=

I have never heard of President of the People Republic of China Hu Jintao being involved directly in any of such issues as child enslavement for his personal amusement.
Concerning the 4 years old kid being raped and killed in the MOSQUE I never heard anything similar happening in any civilized country islamic or not.
It is evident that you, asking for the moderators to shut this thread down, are affected by a severe form of Stockholm Syndrome.
Ek and Dubai are two pieces of the same business and are owned by the same guy aka the "ruler" which interest is not for sure the well being or the happyness of the EK pilots ( that are more and moregetting close close the jockey kid situation...) but to find any possible way to milk as much money as possible out of it to repay is 80 billion dollar debt. Social responsability, freedom, human and worker rights are just words there.
Dubai is negation of 400 years of progress and an example of the level of stupidity that mankind can reach when what it counts is only MONEY.

SMA, I was born and bred in one of your so called civilized countries and was exposed to violence on many levels, I recall rapes, kidnappings and murders of children on an unfortunately regular basis.
I really think you should look closer into the history and present day of the Roman Catholic church before you start on the old civilized routine ref churches etc.
By the way do you remember the child rape and cover up by US soldiers in Iraq a few years back or does that not count as they were civilized people in an uncivilized country plus they didn't do it in a mosque.
look, there are seriously sick/perverted people out there in every human society which unfortunately you seem to have conveniently forgotten.
Please come up with something relevant to EK that isn't pasted from the National Newspaper.:ugh:

DUBAI — Alexandre Robert, a French 15-year-old, was having a dream summer in this tourist paradise on the Gulf. It was Bastille Day, and he and a classmate had escaped the July heat at the beach for an air-conditioned arcade.

Just after sunset, Alex was rushing to meet his father for dinner when he bumped into an acquaintance, a 17-year-old native-born student at the American school, who said he and his cousin could drop Alex off.

There were, in fact, three Emirati men in the car, including a pair of former convicts, aged 35 and 18. They drove Alex past his house and into a dark patch of desert, between a row of new villas and a power plant, took away his cellphone, threatened him with a knife and a club and told him they would kill his family members if he ever reported them.

Then, Alex says, they stripped off his pants and one by one sodomized him in the back seat of the car. They dumped Alex on the side of the road across from one of Dubai's luxury hotel towers.

Alex and his family were about to learn that despite Dubai's status as the Arab world's paragon of modernity and wealth, its legal system remains a perilous gantlet when it comes to homosexuality and legal protection of foreigners.

The authorities not only discouraged Alex from pressing charges, he says; they have left open the possibility of charging Alex with criminal homosexual activity, and neglected to inform him or his parents that one of his attackers had tested HIV positive while in prison four years earlier.

"They tried to smother this story," Alex said by phone from Switzerland, where he fled a month into his 10th grade, fearing a jail term in Dubai if charged with homosexual activity. "Dubai, they say we build the highest towers, they have the best hotels. But all the news, they hide it. They don't want the world to know that Dubai still lives in the Middle Ages."

United Arab Emirates law does not recognize rape of males, only a crime called "forced homosexuality." The two adult men charged with molesting Alex appeared in court Wednesday, and will face trial before a three-judge panel on Nov. 7. The third, a minor, will be tried in juvenile court. Men convicted of sexually assaulting other men usually serve sentences ranging from a few months to two years, legal experts here say.

The two adults have pleaded not guilty to kidnapping with deceit and illicit sexual intercourse.

Rape and assault are not unknown in Dubai, a bustling financial and tourist center where at least 90 percent of the residents are not Emirati citizens. Alex's Kafkaesque journey into the Dubai legal system brings into sharp relief questions about unequal treatment of foreigners that have long been quietly raised among the expatriate majority here. It also throws into public view the taboos surrounding HIV and homosexuality that Dubai residents say have allowed rampant harassment of gays and have encouraged the health system to treat HIV virtually in secret. (Under Emirates law, foreigners with HIV, or those convicted of homosexual activity, are deported.)

Prosecutors here tout their system as modern, Western-style and fair.

"The legal and judicial system in the United Arab Emirates makes no distinction between nationals and non-nationals," said Khalifa Rashid Bin Demas, head of the Dubai Attorney General's technical office, in an interview. "All residents are treated equally."

Dubai's economic miracle - decades of double-digit growth spurred by investors, foreign companies, and workers drawn to the tax-free Emirates - depends on millions of foreigners, working jobs from construction to senior financial executives. Even many of the criminal court lawyers are foreigners, because there are not enough Emiratis.

Lawyers here say that corporate law heartily protects foreign investors, but that equal protection before the law does not always extend to foreigners in criminal court. "Equality exists in theory, but not in practice," said a Western diplomat with close knowledge of the Dubai legal system.

Alex's case has raised diplomatic tensions between the Emirates and France, whose government has lodged official complaints about the apparent cover-up of one assailant's HIV status and other irregularities in the case.
