In light of the new anti discrimination laws concerning age I am assuming that the UK MOD have suitably water tight reasons as to why we have to "dump" perfectly able soldiers sailors and airman just because they happen to be 38/40, pretty simplistic but you get my drift.;)

The 'answer' is that the armed forces are exempt from this legislation - as they are from almost all employment legislation.
